Object and acceptance

These terms govern the rental of inflatable kayaks and stand-up paddle boards (SUP) by KayakBenidorm, delivered and collected at agreed public points (car parks and seafront promenades) on the Costa Blanca. Booking and paying for the gear implies full acceptance of these terms.

Who can rent

The person making the booking must be at least 18 years old and will be responsible for the gear. Minors may use the gear only under the responsibility of an accompanying adult, who acts as the contract holder. A valid ID or passport may be requested at delivery.

Requirements and safety

The customer declares to be in good health and physically able to practise this activity, and to be able to swim. Wearing the provided life vest is mandatory while on the water. The gear must not be used under the effects of alcohol, drugs or any medication affecting reaction capacity. Our gear is inflatable recreational equipment that does not require a nautical licence (Order FOM/3200/2007); it may only be used during daylight and within the areas allowed by the local maritime authority.

No guided activity

This is equipment rental only, without a guide or monitor. The customer uses the gear under their own responsibility and decision. KayakBenidorm provides basic safety recommendations but does not supervise the activity.

Delivery and return

Gear is delivered and collected at the agreed point and time (full-day rental). The customer must return all the gear and accessories at the agreed time and place, in the same condition as delivered. Late returns may result in additional charges or retention of the deposit for the resulting loss.

Deposit and damage

On delivery day a refundable deposit is held on the customer's card (not a charge, only a temporary hold). It covers loss, theft or damage to the gear while in the customer's care. If the gear is returned in good condition, the deposit is released. In case of damage, loss or theft, the corresponding repair or replacement cost will be charged against the deposit, and explained to the customer.

Liability

The customer is responsible for their own safety and for any damage caused to themselves or to third parties (persons or property) during the rental. KayakBenidorm is not liable for accidents, injuries or damage arising from misuse or from failure to follow the safety recommendations. The customer is advised to hold suitable personal insurance.

Weather and cancellations

The activity depends on weather and sea conditions. KayakBenidorm may postpone or cancel a rental for safety reasons; in that case the customer may choose a new date or a refund of the amount paid.

Data protection

Personal data provided is used solely to manage the booking, in accordance with applicable data protection law (GDPR / LOPDGDD). The customer may exercise their rights of access, rectification and deletion by contacting us.

Applicable law

These terms are governed by Spanish law. Any dispute will be subject to the competent courts of the customer's domicile.
